Terms and Conditions of Business
Standard Terms and Conditions of Business for Hospitality Recruitment Solutions Asia Pacific Co; Ltd (HRS Asia Pacific Co; Ltd), a division of HMS Asia Pacific Co; Ltd, are listed below and require your signature as acceptance prior to any services being provided by HRS Asia Pacific or its subsidiary company’s to you, the client.
Thank you for selecting HRS Asia Pacific Co; Ltd to assist you with your personnel recruitment need. Please find below our terms and conditions for this placement contract:
- Whilst HRS Asia Pacific Co; Ltd makes all reasonable endeavors to safeguard the anonymity of candidates and the confidentiality of clients, and to assess candidates suitability for specified vacancies, it does not warrant that any candidate will be fit for a specific vacancy and makes no representation as to the competence, ability, efficiency, suitability or otherwise of any candidate.
- Clients are therefore required to personally interview, and to approve of, any candidate prior to such candidate commencing employment.
- It is the sole responsibility of the client to satisfy itself as to the references obtained. Any decisions as to whether or not to engage any candidate shall lie solely with, and be the sole responsibility of the client.
- HRS Asia Pacific Co; Ltd offers a replacement guarantee on permanent placements. We will replace a candidate free of charge to our client in the event that an employee placed by HRS Asia Pacific Co; Ltd leaves of their own accord or is released due to incompetence within 92 days of employment.
- The Replacement Guarantee is subject to your payment in respect of the permanent placement fee reaching us not later than 7 days of the candidate commencing employment, and you requesting a replacement in writing 7 days prior to the employee's last working day.
- HRS Asia Pacific Co; Ltd charges a Permanent Placement Fee, which is due and payable within 7 days of the candidate commencing employment with the client. The permanent placement fee charged by us is the amount equal to one (1) months Gross Salary level, as per candidates signed contract with the client. Our fee is not calculated on any other benefits or allowances offered to the candidate.
- After the initial introduction of the Candidate, the Employer may not employ / contract with that Candidate through any third party to avoid payment of the introductory fee. In circumstances the employment / contract of the Candidate shall entitle HRS Asia Pacific Co; Ltd to payment of an introduction / placement fee
- Some mandates may require a more extensive advertising campaign. This will be developed in conjunction with the client, and all expenses incurred in this manner will be charged to the client. Our recruitment fee is charged if any candidate presented by HRS Asia Pacific Co; Ltd is hired for any position by the client , or its representative, any of its divisions, subsidiaries, affiliated, parent company, or any party introduced by the above within 12 months of presentation.
- Please note that all candidates are placed with your organization under the conditions outlined above. Kindly keep this copy for your records.
- HRS Asia Pacific Co; Ltd reserves the right to charge interest at the rate of 2.5% per month on all balances unpaid/overdue after 30 days. We also reserve the right to enlist, and charge for, the service of an attorney or credit collection agency - should this be required.
